Workers earn 1 hour of sick leave for every 30 hours they work, up to 40 hours per year.
It’s against the law for your employer to punish you for using sick leave you’ve earned, or to make you find a replacement for your shift.
Your employer may not ask for documentation unless it’s more than 2 days in a row.
All employers in New Jersey must provide earned sick leave, no matter their size.

Your employer cannot retaliate against you for requesting or using earned sick leave or filing a complaint with NJDOL
Retaliation includes threat, discipline, discharge, demotion, suspension, or reduction in hours, or any other adverse action against you for exercising or attempting to exercise any right guaranteed under the law.
